Terms of service

Clear terms, so we can get on with the teaching.

These terms apply when you enroll a student, buy a package or use this website. They sit alongside the cancellation policy and the privacy policy.

Last updated: October 3, 2026

1. Who these terms are between

"I", "me" and "Upper Hand Tutoring and Test Prep" mean Kristen Amendola, a sole proprietor in Connecticut, United States. "You" means the parent or legal guardian who enrolls a student. Because students are minors, the agreement is always with a parent or guardian.

2. The service

I provide tutoring in English, online on Google Meet, in SAT, ACT and PSAT preparation, IB and AP STEM subjects, GCSE mathematics and science, and core mathematics and science. In-person lessons are available in Fairfield County, Connecticut, on Saturdays and Sundays between 9am and 12pm.

Lessons are one-to-one, in pairs, or in small groups of up to three students working at the same subject and level.

3. Enrollment

Enrollment begins with a free consultation and a short diagnostic. A place is confirmed once you have completed the enrollment and consent form and the first month's payment has been received. I teach a limited number of hours each week; when those are full, new families are offered a place on the waitlist.

4. Fees and payment

  • Your rate is the one confirmed in writing after your consultation. Prices on the website are "from" prices.
  • Lessons are paid in full at the start of each month, in US dollars or euros.
  • The minimum is two sessions per month.
  • A 10% discount applies when you book six or more sessions in a month.
  • Launch offers and rewards (founding-family rates, the sibling SAT rate, referral rewards and the switching credit) are described on the founding families page. One founding offer applies per family; it covers the package bought, or the first three months of monthly lessons, and closes on the date shown.
  • Access Seat rates are agreed privately and reviewed once a year.
  • A lesson is not held until the month's payment has been received.

5. Rescheduling, cancellation and refunds

These are set out in full in the cancellation and refund policy, which forms part of these terms. In short: 48 hours' notice to reschedule, no rescheduling with less notice, and no refunds, except for a new family's risk-free first lesson and the 14-day right to withdraw for families in the EU and UK.

6. Lessons

  • The lesson link is sent to the parent. A parent is welcome to sit in on any lesson.
  • Lessons are not recorded unless you ask. A recording made at your request is for your family's private use.
  • Students need a quiet place, a working camera and microphone, and the materials agreed for that lesson.
  • Students are expected to arrive on time, take part and complete agreed practice between lessons.
  • In a pair or group, each family agrees to respect the privacy of the other students.

7. Progress and results

Every student starts with a diagnostic and written goals, and you may choose a written progress report after every four sessions. I will always tell you honestly how your student is doing. Because results depend on many things outside my control, including the work a student does between lessons, I cannot guarantee a particular score, grade or admission outcome.

8. Academic honesty

I teach students to do their own work. I do not complete homework, coursework, internal assessments, application essays or tests on a student's behalf, and I follow the rules of the IB, College Board, ACT and exam boards on permitted help.

9. Materials

Study guides, worksheets, reports and other materials I create remain my intellectual property. They are for your family's personal use and may not be resold, published or shared publicly. Official test and exam-board materials belong to their owners.

10. Safeguarding and conduct

The safeguarding commitments on this site form part of how I work. I may end a lesson, or end tutoring, where behavior toward me or another student is abusive or unsafe. If I am concerned for a child's safety, I will act on that concern, which may include contacting a parent or the appropriate authority.

11. Ending tutoring

You may stop at the end of any paid month by telling me before the next month's payment is due. I may end tutoring with written notice; in that case, any lessons already paid for and not delivered are refunded.

12. Liability

Nothing in these terms limits liability that cannot legally be limited. Otherwise, my total liability to you is limited to the fees you paid in the three months before the claim arose, and I am not liable for indirect losses or for interruptions caused by events outside my control, such as an internet or platform outage. A lesson lost to an outage on my side is rescheduled at no cost.

13. Governing law

These terms are governed by the laws of the State of Connecticut, United States, and disputes are heard in the courts of Connecticut. If you are a consumer living in the EU or the UK, you keep the protection of the mandatory consumer laws of the country where you live, and you may bring a claim in your local courts.

If something goes wrong, please tell me first. Most things can be put right in a conversation.

14. Changes and contact

I may update these terms. Changes apply from the next paid month, and I will email enrolled families in advance. Questions: [email protected].
